EVALUATION OF REGENT REGULATION NUMBER 7 OF 2022 CONCERNING ENVIRONMENTAL ADMINISTRATIVE SANCTIONS IN PASANGKAYU

Abstract

This research aims to evaluate the implementation of Regent Regulation Number 7 of 2022 concerning Environmental Administrative Sanctions in Pasangkayu Regency and assess its effectiveness in providing administrative sanctions for violations of environmental management. The research is motivated by the importance of enforcing environmental laws to increase compliance by business actors and the public with environmental management provisions. The research used a qualitative approach with a descriptive type which was carried out in Pasangkayu Regency. Research informants were determined using a purposive sampling technique with a total of three informants. Data was collected through interviews and documentation, then analyzed based on William N. Dunn's policy evaluation theory which includes effectiveness, efficiency, adequacy, equity, responsiveness and accuracy. The research results show that this policy has contributed to reducing the level of violations and increasing compliance with environmental management through legal certainty and harmony with national environmental regulations. However, policy effectiveness still faces various implementation obstacles, such as limited supervisory resources, facilities and infrastructure, budget support, as well as the need for more consistent, professional and fair law enforcement. In addition, the success of the policy is supported by the establishment of evidence-based sanctions, clear monitoring procedures, adjusting the level of sanctions to the type and level of violations, and alignment with the national legal framework. This research contributes to assessing the effectiveness of environmental administrative sanctions policies and provides input for local governments to strengthen supervision and improve the quality of implementation of sustainable environmental management policies.
